Panorámica de la actuación notarial durante la pandemia

Transcurridos nueve meses desde el inicio de la pandemia, estamos en condiciones de hacer un breve análisis sobre la forma en que se ha prestado el servicio público notarial durante este tiempo. La buena predisposición de quienes trabajan en las oficinas notariales ha logrado atenuar las dificultades que la exigencia de presencialidad conlleva en el momento actual, pero ello no debe implicar el aplazamiento indefinido de una reforma que es urgente. No tiene sentido mantener la exigencia de presencialidad indiscriminada, para todo tipo de documentos, cuando la videoconferencia permite la intervención notarial a distancia ofreciendo certidumbre en el momento de la formalización del negocio jurídico sin el riesgo que hoy conlleva toda comparecencia personal.

Nine months after the onset of the pandemic, we are in a position to briefly analyse how the notarial public service has been provided during this time. The goodwill of those who work in notarial offices has succeeded in mitigating the difficulties involved in the requirement to appear in person at the present time, but this should not lead to an indefinite postponement of a reform that is urgently required. Persisting with a requirement for appearing in person under all circumstances and for all types of documents makes no sense, when videoconferences mean that notarial interventions can take place online, providing certainty in the formalisation of legal transactions, and without the risks that all appearances in person currently entail.
