¿Quién puede proclamar la derogación tácita de una norma legal?
Una reciente resolución de la Dirección General de Seguridad Jurídica y Fe Pública ha enfrentado el tema del tipo de subasta en la hipoteca y la posibilidad de fijar uno que sea inferior al valor de tasación, siempre que se respete el 75% del mismo, según resulta del texto vigente del artículo 682.2.1º de la Ley de Enjuiciamiento Civil. Al imponer la derogación tácita de una norma legal la resolución suscita serias dudas sobre el alcance de la competencia de este Centro Directivo.
A recent ruling by the General Directorate of Legal Security and Notarial Attestation has addressed the issue of the minimum bid amount at auctions in mortgages, and the possibility of setting an amount that is lower than the appraisal value provided that the threshold of 75% is met, according to the current text of article 682.2.1 of the Civil Procedure Law. By imposing the tacit repeal of a law, the ruling raises serious doubts about the scope of the competence of this Directorate.
