Seguridad social y personal estatutario. Comentario a la jurisprudencia social de los años 2005-2006

El presente trabajo pretende dar a los especialistas en materia de Seguridad Social una visión general sobre la jurisprudencia en la materia dictada por la Sala de lo Social del Tribunal Supremo durante el último año judicial (2005-2006). Desde esta perspectiva se analizan tanto las cuestiones generales en materia de Seguridad Social como aquellas decisiones que han afectado a la interpretación del régimen jurídico aplicable a cada una de las prestaciones de Seguridad Social. Se concluye haciendo un breve resumen de la jurisprudencia emanada sobre el personal estatutario de la Seguridad Social, materia de la que ya sólo conoce la Sala de lo Social respecto de demandas interpuestas antes de la entrada en vigor de la Ley 55/03.

This study intends to bring to the specialists on Social Security Law a general view on the most relevant Court Judgments on the matter that were stated by the Social Chamber of the Supreme Court during the last judicial year (2005-2006). According to it the study analyses the interpretation on the General Questions regarding Social Security Law as well as the Judgments that affects the interpretation on the regulations regarding each of the employment benefits. The study finishes with a briefing on the Court Judgments on personnel employed by public Health institutions Law, being the Social Chamber still in charge of the subject for claims brought to the Social Tribunals before the entry into force of the 55/03 Act.
