Seguridad y constitución

Se presentan las distintas facetas del concepto de seguridad ciudadana en el constitucionalismo americano y europeo. Asimismo, se ofrece una reflexión sobre el término seguridad como principio y como derecho de los ciudadanos, desde las Declaraciones de derechos hasta la actualidad. Se propone el análisis del concepto actual de seguridad desde una perspectiva global integradora. La seguridad se manifiesta hoy, como condición indispensable para la convivencia pacífica, en igualdad y libertad, de la sociedad democrática. Es esencial el compromiso de los poderes públicos para establecer los mecanismos necesarios que permitan garantizar una seguridad plena a sus ciudadanos, con un tejido social estable e integrado que evite los riesgos de seguridad colectivos surgidos por las situaciones de necesidad.

This paper focuses on different views of the concept of security in the European and American Constitutionalism. It also presents a reflection of this term as a citizens’ right, from the initial bills of rights up to nowadays. This research proposes to overcome the knowledge of security understood as law and order and social peace.
We propose the analysis of the current security concept based in a global and integrated perspective. Security emerges as an essential condition for the peaceful coexistence, equality and freedom of democratic societies. It’s necessary the commitment of Public Authorities to establish the basic mechanisms that guarantee global citizens’ security and also a commitment to ensure the existence of a stable and integrated social network, which will avoid collective conflicts arising from situations of need.
