La reforma laboral en Grecia
La incorporación de Grecia en el mecanismo de ayuda financiera del Fondo Monetario Internacional, el Banco Central Europeo y la Comisión Europea en mayo del año 2010 ha supuesto, entre otros, un creciente número de drásticas reformas sobre la legislación laboral. Esta intensa actividad legislativa llevada a cabo durante los dos últimos años y medio, ha causado una serie de problemas legales no resueltos, no sólo por lo que se refiere a la interpretación de estas nuevas disposiciones, sino también en relación con la compatibilidad de las medidas establecidas con la Constitución, con el Derecho Internacional y el Derecho de la Unión Europea. Por añadidura, se ha iniciado un intenso debate sobre el actual Derecho del trabajo y la orientación que está disciplina debe seguir en el futuro, así como sobre el papel que éste debe jugar en el contexto económico por el que actualmente atraviesa Europa. El objetivo de este artículo es el de ofrecer una visión crítica sobre las más importantes reformas que se han llevado a cabo en la legislación laboral griega desde el año 2010 hasta la actualidad. La primera parte del artículo analiza las reformas operadas sobre la vertiente individual del Derecho del Trabajo, mientras que la segunda hace referencia a las modificaciones realizadas en la vertiente colectiva de la disciplina.
The entrance of Greece into the financial support mechanism of the International Monetary Fund, the European Central Bank and the European Commission in May 2010 has triggered, inter alia, a flood of drastic reforms in labour legislation. This intense legislative activity of the last 2, 5 years has caused a series of unsolved legal issues regarding not only the interpretation of the new provisions, but also their compatibility with the Constitution, the international law and the law of the European Union. Additionally, it has initiated a vivid debate on the current and future orientation of labour law, as well as on the role it can play in this new economic environment that has arisen throughout Europe. The aim of this article is to offer a critical overview of the most crucial reforms that have taken place in the Greek labour legislation from 2010 to the present day. The first part of the article discusses the reforms in the area of individual labour law, and the second those occurred in the area of collective labour law.
