La Directiva 2000/35/CE contra la morosidad en las operaciones comerciales: Balance descriptivo del periodo de aplicación 2004-2006

El artículo describe la aplicación de la Directiva 2000/35/CE contra la morosidad en las operaciones comerciales desde la fecha de la adhesión de los nuevos diez Estados miembros hasta finales de 2006. Se analizan asimismo la relación directa existente entre la Directiva y otra legislación comunitaria, existente o en proyecto, así como las sentencias en las que el Tribunal de Justicia se ha pronunciado sobre este tema. Actualmente se está llevando a cabo un estudio externo sobre las consecuencias derivadas de la aplicación de esta Directiva cuyas conclusiones serán recibidas a finales de 2006 por la Comisión Europea.

This article presents an overview of the consequences in the application of Directive 2000/35/EC on combating late payment in commercial transactions. The period covered is 2004-2006. It can be considered that the Directive's effective application coincided with the adhesion of the ten new Member States and, two years after, the European Commission is about to receive the conclusions of an external study on the impact that this Directive has had on the Internal Market. Equally, existing judgments of the Court of Justice on this issue and the relation between the Directive and some other pieces of European legislation are also analyzed.
