Religión y sistema educativo español

Artículo monográfico que sistematiza la posición que ha tenido en el contexto educativo español la religión, partiendo de la Ley General de Educación que en 1970 contempló la asignatura de religión con carácter obligatorio en cada uno de los niveles educativos, hasta la actual Ley Orgánica de Educación, no sin antes analizar toda la problemática planteada por las fases intermedias que han supuesto la LOGSE y la LOCE. Se aborda asimismo el interesante horizonte que la jurisprudencia ha marcado en este ámbito, así como su proyección en el Derecho comparado, lo que hace del estudio un conjunto compacto sobre una cuestión que, desde la época constitucional, no ha dejado de tener una repercusión jurídico-social altamente significativa.

This article traces the place held by Religious Studies in the Spanish education system since the General Act of Education that, back in 1970, treated it as a compulsory subject in all schooling stages until the present Organic Act on Education, going through the various problems posed by the intermediate phases of the LOGSE (Organic Act on the General Organisation of the Education) and the LOCE (Organic Act on the Quality of Education). It also tackles the interesting horizon created by Jurisprudence in this sphere, as well as its impact on Comparative Law, turning the study into a block on an issue that, since the enactment of the Constitution, has constantly had highly significant legal and social repercussion.
