Los delitos contra los recursos naturales y el medio ambiente, con referencia a la reforma introducida por la LO 5/2010, de 22 de junio, y a la jurisprudencia sobre la materia
Se estudian los delitos contra los recursos naturales y el medio ambiente, teniendo en cuenta especialmente la reforma operada por la LO 5/2010, de 22 de junio. El estudio parte de las deficiencias que la regulación penal presenta, referidas entre otros aspectos al uso incorrecto de la técnica de las normas penales en blanco, al abuso de conceptos normativos y a los problemas concursales, proponiendo interpretaciones de los tipos que sean coherentes con los principios de legalidad y de intervención mínima. Asimismo se presenta un análisis de la jurisprudencia en esta materia.
A study of crimes against natural resources and the environment, taking into account reforms introduced by LO 5/2010, 22 of June. The study centered on a deficiency of current criminal regulations, referring to the incorrect application of blank penal law techniques, the abuse of normative concepts and problems of concurrence of criminal offences, among other aspects, in order to suggest interpretations of legal provisions that are coherent with the principle of criminal legality and of minimum intervention. In addition, offers jurisprudence analysis related to this subject.
