Prevaricaciones ambientales: función inspectora, omisión e informes favorables, a tenor del art.329 CP apartado 1º

En este trabajo, se analizan las prevaricaciones ambientales, en especial, las consistentes en silenciar las infracciones que se cometan o en omitir inspecciones en el ámbito ambiental, así como las basadas en informes favorables de licencias manifiestamente ilegales sobre el funcionamiento de industrias o actos contaminantes. Se aborda, por tanto, el estudio del art.329 CP, en su apartado 1º, por la mayor novedad que representan la modalidad omisiva allí prevista por LO 5/2010, de 22 de junio. Para ello, se analiza con detalle la función inspectora en medio ambiente como posible ámbito donde se ciernan nuevas formas de corrupción. Se trata así de contribuir al estudio de dicha actividad administrativa en el ámbito penal, a la vista del protagonismo que tiene en Derecho administrativo ambiental para la supervisión de autorizaciones ambientales/comunicaciones previas y para evitar futuros ilícitos. En suma, el estudio de la inspección ambiental es imprescindible como paso previo a la interpretación de las polémicas prevaricaciones omisivas del art.329.1 CP. Junto a ello, también se atiende al resto de elementos típicos de dichas prevaricaciones, así como a las complejas relaciones concursales que pueden entablar con otros delitos (art.325 CP y art.404 CP, especialmente).

This paper is focused on crimes which pervert the course of the Environmental Administration in Spain. Specially those crimes which consist in silencing the breach of laws during his inspections, or omitting the carrying out of mandatory environmental inspections; and also those crimes consisting in reporting favourably on granting manifestly unlawful permits. In other words, it is analysed the art.329 Spanish Penal Code, first paragraph, which is a criminal provision reformed by Organic Law, 5/2010, June. 22nd. With this aim in mind, the author analyses the administrative function of inspection in Environmental law, as a field in which the corruption is being spreaded. This work trends to contribute to the study of Environmental inspection which is an administrative activity hardly studied in the Spanish criminal doctrine, but very important in order to supervise the respect to environmental authorizations/communications and to avoid future offences. In a nutshell, it is absolutely necessary a research about the environmental inspection as first step to construct the controversial crimes of corruption by omission of the art.329.1 PC. Additionally, the work also pays attention to the other defined elements of these crimes of corruption as well as the difficult concurrences of crimes among other felonies (specially, the ones of art.325 PC and art.404 PC).
