Una sentencia en la federalización del Estado

Se parte de la idea de que la Sentencia sobre el Estatut en la situación de crisis en que se encuentra el Estado Autonómico (STC 31/2010), resulta de gran utilidad, pues esta Sentencia expresa los límites, pero también las posibilidades de desarrollo del Estado autonómico. Se destacan tres enseñanzas en la Sentencia: en primer lugar, rechazo de una deriva confederal del sistema, al proponer un entendimiento correcto del contenido identitario del Estatut. En segundo lugar, clarificación del sistema competencial, rechazando el blindaje intentado, pero acogiendo la mayoría de las determinaciones competenciales del Estatut. Por último, refuerzo de los instrumentos de participación de la Comunidad Autónoma en el ejercicio de las competencias exclusivas del Estado.

The main idea is that the Judgement on the constitutionality of the Estatut expresses the limits, but also the potential for the development of the Autonomous State. Is possible to obtain three teachings of the Judgement: first, the rejection of a confederal system, because the Court proposes a correct understanding of the identitarian content of the Estatut. Secondly, the clarification of the distribution of powers system, rejecting the safeguard of the regional competences tried by the Estatut, but accepting most of the competences determinations. Finally, the strengthening of the participation of the Autonomous Communities in the exercise of the exclusive competence of the State.
