El matrimonio entre personas del mismo sexo en el sistema constitucional español
Este trabajo analiza la regulación del matrimonio entre personas del mismo sexo en la Constitución española. El autor sostiene que la forma adecuada de definir el matrimonio es entenderlo como derecho de libertad y no como una garantía institucional; ese derecho de libertad garantiza el matrimonio con personas del mismo o diferente sexo.
This paper analyzes the legal frame of same-sex marriage in the context of the Spanish Constitution. The author argues that the proper definition of marriage must be understood as a civil liberty, not as an institutional guarantee. This right protects marriage between persons of the same-sex or different sex.
