El control parlamentario de la legislación delegada en los ordenamientos autonómicos

El objeto del presente trabajo es una investigación sobre las formas de control parlamentario de la legislación delegada una vez se lleva a cabo la elaboración por el poder ejecutivo, del texto normativo resultado de la misma. Del resultado de dicha investigación se colige que no existe uniformidad de tratamiento, en las distintas Comunidades Autónomas, constatándose la existencia de dos bloques de regulación, uno de Comunidades que prevén dicho control en todo caso y otras que solo cuando lo prevea la ley de delegación. Se estudia la regulación del artículo 82.6 de la Constitución Española y por último se avanzan propuestas de homogenización en virtud del principio constitucional de seguridad jurídica y de una reforma del artículo 82.6 de la Constitución Española.

The purpose of this work is to investigate the forms of parliamentary control of the delegated legislation (statutory instrument) once the executive power has been elaborated, the normative text resulting from it. From the result of this investigation it is found that there is no uniformity of treatment in the different Autonomous Communities, being verified the existence of two blocks of regulation, one of Communities that foresee this control in any case and others that only when foreseen by the law of delegation . The regulation of Article 82.6 of the Spanish Constitution is studied and finally proposals for homogenization are made in accordance with the constitutional principle of legal certainty and a reform of Article 82.6 of the Spanish Constitution.
