Precisando algunas reglas de la responsabilidad medioambiental (Análisis del alcance de las Sentencias del Tribunal de Justicia (Gran Sala) de 9 de marzo de 2010 [TJCE 2010/70 y 2010/69])
Las sentencias de la Gran Sala del Tribunal de Justicia de 9 de marzo 2010, ambas sobre los asuntos Raffinerie mediterranee SpA y otros contra Ministero dello Sviluppo economico y otros, contribuyen a clarificar la interpretación que se le haya de dar a determinados extremos de la Directiva 2004/35/CE y, por lo que afecta al Derecho español, a ciertos extremos de la LRM. En estas resoluciones, el Tribunal de Justicia analiza tres cuestiones clave: el carácter objetivo de la responsabilidad medioambiental; la problemática relación de causalidad y su presunción; y el procedimiento y criterios en torno a la adopción de las medidas de reparación del daño ambiental.
The Judgements of the European Court (Grand Chamber) 9 march 2010, both dealing with Raffinerie mediterranee SpA and others v. Ministero dello Sviluppo economico and others, help to clarify the interpretation of certain extremes of Directive 2004/35/CE and of the spanish Enviromental Liability Act. In these judgements, the European Court analises the following key matters: the non-negligence model of the enviromental liability; the problems related with causation and its presumption and the procedures to be taken in the implementation of the remedial measures.
