Aproximación del proceso penal en Europa: proceso penal europeo o europeización del proceso penal

El objetivo de estas líneas es efectuar un breve repaso del recorrido comunitario propiciando un primer balance de lo acaecido, los éxitos y los fracasos, sin renunciar paralelamente a incorporar algunas consideraciones en torno al frágil equilibrio entre seguridad y garantías y a los desencuentros entre las diferentes jurisdicciones competentes para la tutela de los derechos supranacionales. El recorrido se inicia con una breve mirada al devenir de la Unión Europea a partir de los años 90 hasta llegar a las diversas etapas en el deseo de armonización de la justicia penal: la asistencia judicial, el mutuo reconocimiento y la cooperación reforzada como último recurso contemplado en el Tratado de Lisboa junto a la desaparición de los pilares y la decidida apuesta, al menos sobre el papel, hacia una aproximación de la legislación penal y procesal penal. La incorporación de la Carta Europea de Derechos Fundamentales (CEDDFF) al TFL y el tan repetido como incumplido compromiso de la adhesión al Convenio Europeo de Derechos Humanos (CEDDHH) servirá para una obligada referencia al papel otorgado al TEDDHH, al TJCE y a los Tribunales Constitucionales en la tutela del complejo entramado de derechos y garantías que se entrecruzan en el ámbito comunitario e interno.

The purpose of this work is: setting down bases for common reflection at a historic moment that is indeed of particular relevance, making a balance of events, successes and failures, fostering discussion as to which is the best road to take and, at the same time, which road can be taken and trying to provide elements that contribute to deciding between European criminal proceedings or the Europeanisation of criminal proceedings on the one hand and, on the other, encouraging required elements regardless of the option that is chosen to reach the necessary balance between the (at the present time predominant) tendency to guarantee security as far as guarantees are concerned. The paper begins with a brief examination of the development of the Union from the 1990s to present day and the now sectoral issues on which the interest and development of criminal proceedings in Europe have focused (economic interests, terrorism and crimes related to the information Society) to the various stages of the desire for the harmonisation of criminal justice: judicial assistance and mutual recognition and enhanced cooperation as a final resource, as considered in the Treaty of Lisbon. This will be joined by repeated reference to the ECtHR and the ECHR as an agreed starting point for the rights that are to be respected and the role of guarantor awarded to the ECtHR and the ECJ, as well as the situation of the judge of each member state in the complex role awarded to him/her by the various Community and domestic legislations.
