‘Emptio venditio’ y ‘iusta causa traditionis’ (A propósito de algunos libros recientes)

La pubblicazione recente di alcune monografie che affrontano, con soluzioni differenti e nell’ambito di percorsi di ricerca diversi, alcuni dei nodi problematici principali in materia di compravendita e di negozi traslativi, suggerisce una nuova riflessione su alcune questioni che concernono sia la struttura della vendita e delle obbligazioni del venditore nel diritto romano classico e nel diverso ‘sistema giustinianeo’, che ha alterato le soluzioni dei giuristi riproponendole nell’ambito di un modello diverso, risultato di una profonda evoluzione degli assetti proprietari e dei modi di trasferimento, percepibile già nel diritto postclasssico, sia infine i problemi posti dalla interpretazione delle fonti giustinianee nella ‘tradizione romanistica’ ed i rapporti fra questa interpretazione e la formazione delle differenti soluzioni adottate nelle codificazioni moderne.

The appearance of some recent publications that deal with -using different solutions and diverse lines of investigation- some of the main problems related to buying and selling and operations of transference suggest a new reflection on the structure of the sale and the obligations of the seller in classic Roman law and in the diverse "Justinean system". This has altered the solutions given by jurists by situating them within the framework of a different model, a result of a profound evolution in the position of proprietors and in the modes of transference, which can be perceived as early as post-classical Roman law, and manifests itself in the problems derived from interpretation of Justinean sources of law in the "Romanistic tradition", and the relation between said interpretation and the formation of the different solutions adopted by modern codifications.
