Es por todos sabido que la teoría del negocios jurídicos es una construcción de la dogmática moderna, y que los jurisconsultos romanos fueron estudiando las distintas situaciones que merecían ser protegidas. Hoy, de la mano de Cicerón y sus Topica, y jugando con su tratamiento sobre la contrariedad, proponemos un acercamiento a uno de los llamados accidentalia elementa, la condictio y a los distintos requisitos que conforman su concepto.
It is well known that the theory of the facts and legal transactions is a construction of modern dogmatic theorists, and that the Roman jurisconsults were studying the different situations that deserved to be protected. Today, with the help of Cicero and his Topica, and working with his treatment. on the counterpropositions, we propose an approach closer to one of the called accidentalia elementa, the condicio, and the different requirements of his definition.
