L’ordine giuridico romano. “Complessità” del reale e “continuismo” di fondo nella visione storiografica di Alessandro Corbino

Nella costruzione dell’ordine romano che si delinea ripercorrendo la visione storiografica di Alessandro Corbino, l’evoluzione del pensiero giuridico risulta essere l’esito del continuo adattamento dei più antichi principi giuridici, che l’a. definisce in termini di ‘continuismo’ culturale, operante nell’ambito di una concezione del diritto connotata – sin da subito – da una “complessità” di sistema. Nella produzione di Corbino i due profili, nella loro unitarietà concettuale, non solo sono costantemente rintracciabili, ma costituiscono lo ‘stampo’ entro il quale viene riproposta la lettura del diritto privato romano.

In the construction of Roman Law which outlines tracing the historiographical view of Alessandro Corbino, the evolution of Law thinking appears to be the outcome of the continuous adaptation of the oldest Law principles that the author defines in terms of cultural “continuity”, operating as part of a conception of Law characterized – from the very beginning – by a degree of systemic “complexity”. In the production of Corbino, the two profiles, in their conceptual unity, not only are constantly traceable, but they constitute the mould within which the reading of the roman private law is offered.
