La jurisdicción constitucional: ¿un problema?

La jurisdicción constitucional es una institución de aparición todavía reciente en la mayoría de ordenamientos jurídicos, y por ello se la observa en no pocas ocasiones con cierta desconfianza, o incluso entrando en competencia con el Tribunal Supremo. Se duda incluso sobre su naturaleza jurídica, su posición, y hasta sobre los efectos de sus resoluciones. En todo caso, cuando su misión consiste en revisar sentencias, su posición y naturaleza son las de un auténtico órgano jurisdiccional, teniendo sus resoluciones efectos de cosa juzgada, sin descartar su eficacia como precedente. En estas condiciones, es discutible la utilidad de la existencia de una rama autónoma del Derecho procesal dedicada monográficamente a esta jurisdicción.

The constitutional court is still an institution of recent appearance in the most legal systems, and therefore it is often observed with mistrust or even in concurrence with the Supreme Court. Its legal nature, position, and even the effects of their decisions are discussed. Anyway, when its task is the revision of judgments, its position and nature are those of a real court, and its decisions have res judicata effects, and they also may be considered as precedents. After all these considerations, the utility of an autonomous branch of procedural law dedicated exclusively to the constitutional court/s is discussed.
