El Estado unitario: La reiterada fórmula de la organización territorial en Colombia. Mutaciones y tendencias

El presente artículo analiza la organización territorial del Estado colombiano a partir de su constante constitucional cifrada en el modelo territorial unitario, con algunos leves interregnos de forma de Estado federal. Asimismo observa la impronta francesa en el tema territorial, reflejada entre otros aspectos, en la imitación de la figura regional, aún inédita y la departamental. Por supuesto, no se trata del mismo Estado territorial galo, pero sin dudas este ha sido el Estado paradigmático en materia de distribución del poder en el territorio, la descentralización “meramente” administrativa, la frustrada regionalización y la tendencia a la asociatividad territorial. En todo caso, el Estado colombiano, tal como se demostrará, está en pleno proceso de mutación y transformación, eso sí, sin alejarse definitivamente de su constante territorial histórica: el modelo unitario.

This article analyzes the territorial organization of the Colombian State from its constitution which is encoded in the territorial unit model, with some mild lapses where a federal state was adopted. It will also take into account the French relevance in the territorial issue which is reflected, among other aspects, in the imitation of the “region” figure, still untold and the “departmental” figure. Of course, this is not the exact same concepts used in the French territorial state, but no doubt this has been a model state in terms of power distribution inside the territory, decentralization on “merely” administrative subjects, the frustrated regionalization, and the tendency towards the territorial associativity. In any case, the Colombian state, as it will be shown, is in the process of mutation and transformation, but, without drifting away from its constant territorial history: the unitary model.
