La interpelación hereditaria del artículo 1005 del Código Civil
El artículo 1005 del Código Civil se ha modificado por la Ley de la Jurisdicción Voluntaria. La interpelación al heredero para que acepte o repudie, la llamada interpellatio in iure, ha dejado de ser judicial, para convertirse en competencia exclusiva del notario. Cualquier heredero distinto del interpelado está ahora claramente legitimado para instar la interpelación hereditaria. El silencio del interpelado se sanciona no solo con la tradicional prohibición de repudiar la herencia, sino también con la prohibición de acogerse al beneficio de inventario.
Article 1005 of the Civil Code has been amended by the Voluntary Jurisdiction Act. Plea requiring an heir to accept or repudiate, the so called interpellatio in iure, is no longer under the jurisdiction of courts, hence becoming an exclusive competence of a notary. Any other heir is now clearly entitled to urge this hereditary plea. Penalty for his or her silence is not only the traditional prohibition of repudiating, but also a prohibition to request benefit of inventory.
