¿Jaque mate al dualismo?

A veces el Derecho parece una partida de ajedrez, y no hay partida más intensa que la que se juega entre el monismo y el dualismo. EL autor intenta resolver si la reciente reforma del artículo 207 de la Ley Hipotecaria ha supuesto que uno de los jugadores -el monista- gane ventaja, o incluso definitivamente acabe esta partida que parece infinita. El tablero donde se libra la batalla es nada menos que el de los efectos del Registro de la Propiedad. Efectos que dan sentido a la institución, puesto que su función es la de proporcionar seguridad al tráfico inmobiliario, y de esta manera facilitarlo y potenciarlo, favoreciendo el desarrollo económico.

Sometimes the law looks like a chess game, and no more intense game that is played between monism and dualism. The author attempts to resolve the issue of whether the recent reform to Article 207 of the Mortgage Law has meant that one of the players -the monista- outwits, or even definitely ends this game which seems without end. The board where the battle is fought is nothing less than the effects of Land Registry. Effects that give meaning to the institution, since its function is to provide security to property transactions, and thus facilitate and strengthen it, promoting economic development.
