Igualdad en el tratamiento fiscal de los divorcios judicial y notarial: ¿por analogía o por interpretación extensiva?

El divorcio notarial ha sido legalmente introducido y detalladamente regulado en la LJV en pie de igualdad con el divorcio judicial. No cabe ver en ambos divorcios dos instituciones diversas sino dos especies de una misma institución, con idéntico régimen salvo en lo que la Ley quiera que, como excepción, difieran. Al no haberlo señalado así expresamente cabe entender por tanto que la laguna contenida en las normas tributarias, muchas de las cuales siguen hablando de divorcio judicial, deberá integrarse por la razón general paritaria de aquella LJV, operando en este caso el mecanismo de la interpretación extensiva.

Notarial divorce has been legally introduced and regulated in detail in the LJV to put it on an equal footing with judicial divorce. It is not possible to see in both types of divorce two different institutions but rather two species of the same institution. The only distinction is in the legal intention of each, which differs. Since it is not expressly stated in this way, it is possible to understand that the loopholes contained in the tax rules, many of which continue to speak of judicial divorce, must be integrated by the LJV, operating in this case as the mechanism of interpretation.
