Constitución, Autonomía, Derecho Privado y razón -o sinrazón-política
El presente trabajo examina con sentido crítico el actual reparto de competencias entre el Estado y las Comunidades Autónomas en relación con el Derecho civil, o mejor cómo algunas Comunidades llevan al límite esa competencia, en términos que fuerzan la interposición del oportuno recurso de inconstitucionalidad. Se presta también especial atención al tema de los consumidores y las cláusulas abusivas, en relación sobre todo con la abundante doctrina sentada por la Dirección General delos Registros y del Notariado y el reciente pronuncia-miento del Tribunal Constitucional sobre el Código de Consumo de Cataluña.
This article is a critical examination of the current distribution of competences between the Spanish Government and those of the Autonomous Communities relating to civil law, and how some Communities appropriate these competences to their maximum limits, in ways that leave no alternative to filing the appropriate appeal on the grounds of unconstitutionality. The article focuses particularly on the issue of consumers and abusive clauses, especially as regards the extensive doctrine established by the General Directorate of Registries and Notaries, and the recent ruling by the Constitutional Court on the Consumer Code of Catalonia.
