Contribución al balance de la Constitución española de 1978 al cumplir 40 años

La Constitución española de 1978 pertenece, sin duda posible, a la generación de constituciones de la renovación, del renacimiento constitucional del siglo XX, que siguen vigentes en los países europeos fundadores de ese movimiento. Es una hermana más joven y tardía que también, como aquéllas, surge de las aflicciones de una guerra y una larga dictadura. La Constitución de 1978 noes, todavía, la más longeva de nuestra historia, pero sí es la que con más éxito y de modo más directo y efectivo ha regido nuestra convivencia. El único problema que se le ha resistido es el del nacionalismo catalán, siendo la solución de esta disidencia el reto mayor de la actual generación de constitucionalistas.

The Spanish Constitution of 1978 undoubtedly belongs to the generation of constitutions dating from the constitutional renewal or renaissance of the twentieth century, which remain in force in the European countries that founded the movement. It is a younger sibling and a late arrival, which like its counterparts elsewhere emerged from the ordeals of a war and a long dictatorship. The 1978 Constitution is not yet the longest-lived in Spanish history, but it is the Constitution that has most successfully and most directly and effectively governed the Spaniards' coexistence. The only problem that it has been unable to resolve is the issue of Catalan nationalism, and a solution to this discord is the greatest challenge for the current generation of constitutionalists.
