El razonamiento jurídico como método crítico reflexivo: elogio a Vallet de Goytisolo

El presente artículo intenta ofrecer una visión compendiada de los postulados del realismo metódico, corriente a la que fue introducido el autor de la mano del reconocido jurista Vallet de Goytisolo. El escrito se divide en tres partes, que se identifican con tres tesis principales de este realismo, a saber: el carácter práctico de la ciencia del Derecho; el razonamiento jurídico como un proceso deliberativo y argumentativo; y la decisión jurídica como acto de determinación o individualización del Derecho. Paralelamente al desarrollo de estas tesis, surgirán algunas posiciones críticas motivadas por la situación actual de la ciencia jurídica y, también, algunas conclusiones para defender la importancia que la Jurisprudencia tiene en la educación del intelecto jurídico.

This article provides a summary of the theories of methodical realism - a school of thought to which the author was introduced by the renowned jurist Vallet de Goytisolo. The paper is divided into three parts, based on three main theses of this realism, namely: the practical nature of the science of Law; legal reasoning as a deliberative and argumentative process; and legal decisions as an act of determination or individualisation of the Law. Some critical positions arising from the current situation of legal science will arise as these are considered, as well as some conclusions advocating the importance of jurisprudence in the education of the legal intellect.
