Plazo para los otorgamientos sucesivos en las pólizas intervenidas por notario

De acuerdo con lo establecido en el artículo 197 ter, párrafo 1º RN en las pólizas objeto de intervención, no se requerirá la concurrencia simultánea ante el notario de los distintos otorgantes, pudiendo tener lugar en momentos diferentes, salvo que una disposición legal o reglamentaria, o el notario o cualquiera de los interesados la exija. No es preceptiva, así, en materia de pólizas objeto de intervención notarial, a diferencia de las escrituras públicas, la “unidad de acto”, pudiendo tener lugar otorgamientos sucesivos pero, como señala el párrafo 2º de este mismo artículo, la incorporación al protocolo o al Libro Registro se produce con la primera intervención del notario, esto es, en la fecha del primer otorgamiento. Los otorgamientos sucesivos en las pólizas deberán recogerse en el mismo documento mediante diligencia de intervención, si se producen dentro de los sesenta días naturales siguientes; y los que tuvieran lugar con posterioridad, por medio de una nueva póliza con el mismo contenido, conforme al sistema de póliza desdoblada previsto en el tercer párrafo del artículo 197 RN.

According to the provisions of article 197(iii), paragraph 1 of the Notarial Regulations, in notarised policies, the simultaneous concurrence before the notary of the various executors is not required, and this may take place at different times, unless a legal or regulatory provision, the notary or any of the interested parties demand it. This means that unlike public deeds, in notarised policies a single continuous act is not therefore mandatory. Subsequent acts may take place but as indicated in paragraph 2 of the same article, the incorporation into the protocol or the registry book takes place with the first certification by the notary, or in other words, on the date of the first act. Subsequent acts in policies must be included in the same document by means of a notarial certification, if they take within the following sixty calendar days; and those that took place afterwards, by means of a new policy with the same content, according to the system of “split proceedings” stipulated in the third paragraph of article 197 of the Notarial Regulations.
