Un Código civil para el siglo XXI

Un Código civil, del país que sea, debe ser el reflejo de una sociedad en sus relaciones personales, familia-res, contractuales, patrimoniales y sucesorias. Un Código civil es, junto con la Constitución, la principal base de cualquier sistema, incluso en los sistemas comunistas. De ahí la importancia del Código civil como texto normativo. El Código civil no puede ser un texto inamovible, como tampoco lo puede ser la Constitución. En el siglo XIX, el Código civil de cualquier nación era el Código de los burgueses, en el siglo XX el de los ciudadanos, y en el siglo XXI debe ser el de la sociedad civil y digital.

In any country, a Civil Code must reflect its society in terms of its personal, family, contractual, property and inheritance relationships. Together with the Constitution, a Civil Code is the main basis of any system, even under communism. Hence the importance of the Civil Code as a regulatory text. The Civil Code cannot be an immutable text, and nor can the Constitution. In the nineteenth century, any nation's Civil Code was the Code of the bourgeoisie, in the twentieth century it was the Code of citizens, and in the twenty-first century it must be the Code of civil and digital society.
