Incidencias de la Ley reguladora de los contratos de crédito inmobiliario en la práctica de los juzgados especializados

Aprobada la Ley reguladora de los contratos de crédito inmobiliario, se analizan en este artículo los aspectos de la misma que mayor relación e incidencia puedan tener en la práctica de los Juzgados especializados en esta materia: el ámbito subjetivo de aplicación de la ley; las cláusulas suelo; la regulación imperativa de los gastos hipotecarios y los intereses de demora, que difieren de la jurisprudencia sentada por el Tribunal Supremo sobre la materia; la aplicación retroactiva de los requisitos para dar por vencido anticipadamente el préstamo; y la regulación del principio de transparencia, con la equiparación de la FEIN y oferta vinculante y la nueva función de control atribuida al notario. Todo ello en relación con la jurisprudencia del Tribunal Supremo.

After the enactment of the Law regulating Mortgage contracts, this article analyses the aspects which may be most closely associated with and have the greatest impact on the work of the courts specialising in this field: the subjective scope of application of the law; "floor clauses"; the mandatory regulation of mortgage costs and late payment interest, which differ from the jurisprudence established by the Supreme Court on the matter; the retroactive application of requirements for declaring repayment of the loan due; and the regulation of the principle of transparency, with the comparison of the European Standardised Information Sheet and the binding offer and the new role of oversight assigned to the Notary. All the above considerations are related to the jurisprudence of the Supreme Court.
