La firma electrónica del fedatario militar

En el nuevo escenario jurídico basado en la digitalización la firma electrónica ha supuesto uno de los avances más importantes al establecer una forma de identificación digital cada día más frecuentemente utilizada. El Notariado no ha sido un mero sujeto pasivo en este proceso y reguló la utilización de la firma electrónica por los notarios desde el año 2001, por lo que hoy en día son múltiples los supuestos de su utilización. Sin embargo, en el caso de los fedatarios militares, si bien cuentan con un sistema de firma electrónica reconocida que posibilita su empleo para ejercer las funciones administrativas propias de la fe pública militar cuando actúa en territorio nacional y en tiempo de paz, su utilización se dificulta cuando se encuentra en campaña, acompañando a una fuerza en misión en el extranjero, y ejerce funciones de fe pública en el ámbito del derecho privado.

The electronic signature has been one of the most important breakthroughs in the new legal landscape based on digitalisation, as it creates a means of digital identification that is increasingly widespread. The Notarial Profession has not been a mere bystander in this process, and the use of the electronic signature by notaries has been regulated since 2001, meaning that there are many circumstances in which it is used today. However, although military notaries have a recognised electronic signature system which can be used to carry out the administrative functions of military notaries when they act in Spain and in peacetime, it is difficult to use on campaigns, when accompanying a force on mission abroad, and when performing notarisations in the field of private law.
