Fundamentación versus publificación de la escuela concertada hacia una actualización de las razones de los conciertos educativos

Este artículo subraya la necesidad de ahondar en los fundamentos de los conciertos educativos como forma de financiación pública de la escuela no estatal, y la importancia de concienciar a los sujetos implicados en ella acerca de los mismos. Para ello, en primer lugar, aborda el fundamento jurídico constitucional del régimen de conciertos. Estudia después la relación entre la escuela concertada, el papel del Estado en educación y la idea de subsidiariedad, a la luz del modelo educativo lombardo. Examina, en tercer lugar, el fenómeno de la “publificación” de la escuela concertada. Por último, reivindica los fundamentos jurídicos y sociopolíticos de la libertad de enseñanza y de los conciertos. Para concluir, sostiene que el compromiso con la libertad de enseñanza y el pluralismo exige realismo y prudencia, no dar nada por descontado, privilegiar los retos compartidos y no romper el consenso constitucional

This article highlights the need to delve into the foundations of educational contracts as a way of public funding of the non-state school, and the importance of raising awareness of the subjects involved in it. To this aim, firstly, it addresses the constitutional legal basis of the regime of educational contracts. Secondly, it studies the relationship between the publicly funded non-state school, the role of the state in education and the idea of subsidiarity, in the light of the Lombard educational model. Thirdly, it examines the phenomenon of the “publification” of the non-state and publicly funded school. Finally, it claims for the legal and sociopolitical foundations of the freedom of education and of the educational contracts. To conclude, it stresses that the commitment to freedom of education and pluralism requires realism and prudence, not taking anything for granted, privileging shared challenges and not breaking the constitutional consensus.
