La liberte de religion, en France, aux temps du coronavirus

El estado de emergencia sanitaria vinculado a la pandemia COVID-19 y decretado en la gran mayoría de los países europeos ha creado una situación completamente nueva, en particular en lo que respecta a sus consecuencias en materia de libertades civiles y derechos fundamentales. En particular, la libertad de religión, entendida en su dimensión colectiva, se vio considerablemente restringida durante el período de confinamiento, restricciones justificadas por la necesidad imperiosa de limitar la propagación del virus. Ciertamente, la libertad religiosa, en su dimensión interior, que es por su propia esencia absoluta, no se ve afectada de ninguna manera. Pero la decisión de prohibir temporalmente las reuniones religiosas ha socavado la coexistencia religiosa. El presente artículo tiene por objeto esbozar el balance francés de la libertad religiosa en la época del coronavirus y examinar esta tensión sin precedentes entre el derecho a la protección de la salud (según el artículo 11 del Preámbulo de la Constitución de 1946, la Nación "garantiza a todos (...) la protección de la salud"), la salvaguardia del orden público, objetivo de valor constitucional, y la protección de la libertad fundamental de religión. Se distinguirán tres períodos (justo antes del confinamiento; durante el confinamiento; durante el desconfinamiento), cada uno de los cuales ilustra una articulación singular, a veces problemática, entre los imperativos de la salud pública y la libertad religiosa.

The state of health emergency linked to the COVID-19 pandemic and decreed in the vast majority of European countries has created a completely new situation, particularly in terms of its consequences with regard to civil liberties and fundamental rights. In particular, freedom of religion, understood in its collective dimension, was considerably restricted during the period of confinement, restrictions justified by the imperative need to limit the spread of the virus. Certainly, religious freedom in its inner dimension, which is by its very essence absolute, is by no means affected. But the decision to temporarily ban religious gatherings has undermined religious coexistence. This article sets out to outline the French account of freedom of religion in the days of the coronavirus and to examine this unprecedented tension between the right to protection of health (according to Article 11 of the Preamble of the 1946 Constitution, the Nation "guarantees to all (...) the protection of health"), the safeguarding of public order, an objective of constitutional value, and the protection of the fundamental freedom of religion. Three periods will be distinguished (just before “confinement”; during “confinement”; during “deconfinement”), each illustrating a singular, sometimes problematic articulation between public health imperatives and religious freedom.
