La intervención de las organizaciones nacionales en el sistema de informes de la Carta Social Europea: una cita insoslayable con las «observaciones»
El cumplimiento de la Carta Social Europea se supervisa a través del sistema de informes y del procedimiento de reclamaciones colectivas. Por el momento, en España sólo es aplicable el primero, obligatorio para todos los Estados que han ratificado alguna de sus versiones, puesto que no ha suscrito el segundo, de carácter voluntario. Durante la tramitación, las organizaciones nacionales que estén afiliadas a las correspondientes de nivel internacional de empleadores y de trabajadores más representativas, así como las de carácter no gubernamental pueden presentar observaciones al informe gubernamental (art. 23.1 de la CSE). Se trata de una actuación trascendental para la monitorización que realiza el Comité Europeo de Derechos Sociales, pues le permiten contextualizar en toda su dimensión la situación a examinar para determinar la conformidad o no al texto normativo. Este análisis proporciona algunas directrices con la finalidad de contribuir a la consideración de este trámite por los sujetos legitimados y se incorpore habitualmente a su actividad.
The implementation of the European Social Charter is supervised through the reporting system and the collective complaints procedure. For the moment, in Spain only the first one is applicable, mandatory for all the nations that have ratified some of its versions, since it has not subscribed the second one, with voluntary application. During the processing, the national organisations that are members of the international organisations of employers and trade unions, as well as the non-governmental ones, can provide comments to the governmental report (art. 23.1 of the ESC). This a significant action of monitoring, that is performed by the European Committee of Social Rights, since allows to contextualize in the whole dimension the situation to analyze, in order to determine the conformity or not of the regulatory framework. This analysis provides some guidelines with the purpose to contribute to the consideration of this process by authorised parties and the regular integration to their activity.
