Autocontrato y calificación registral: la tarea pendiente de la Dirección General
El autocontrato forma parte del juicio notarial de suficiencia del poder y, por tanto, está excluido de la calificación registral, de acuerdo con el artículo 98 de la Ley 24/2001, tal y como ha sido interpretado por el Tribunal Supremo. A punto de cumplirse veinte años de la entrada en vigor de este precepto, queda una sola tarea pendiente a la Dirección General, que es revisar su incongruente doctrina sobre la calificación del autocontrato.
Self-dealing is part of the notarial opinion of the sufficiency of the power of attorney, and is therefore excluded from the registrar's statement of validity, in accordance with article 98 of Law 24/2001, as interpreted by the Supreme Court. Twenty years after the entry into force of this regulation, there is only one remaining task for the General Directorate, which is to review its inconsistent doctrine on the statement of validity of self-dealing.
