Las arras en el Código Civil de Cataluña
Las arras son un medio útil para ordenar la fase inicial de una compraventa, presentan importantes flaquezas por la frecuente falta de adecuada regulación del resto de elementos determinantes de la prestación del consentimiento y de la idoneidad del objeto del llamado “contrato final”. Cuanto más se prevea de la futura compraventa, mayor seguridad proporcionarán las arras. En Cataluña se ha procurado fomentar su utilidad a través de la escritura pública, acompañada del depósito notarial, la constancia registral y un tratamiento fiscal neutro. Se ha dado un paso en la buena dirección que previsiblemente redundará en un aumento de la seguridad jurídica y, al mismo tiempo, de la recaudación fiscal por cuanto estimula la declaración transparente del precio a pagar en su día.
While an earnest money deposit is a useful means of arranging the initial phase of a sale, they have significant shortcomings due to the frequent lack of adequate regulation of the other elements determining the provision of consent and the suitability of the object of the "final contract." The greater the likelihood of the future sale, the greater security the earnest money deposit will provide. Efforts have been made in Catalonia to enhance its usefulness through public deeds, accompanied by notarial deposits, the registration certificate and neutral tax treatment. This is a step in the right direction, which will foreseeably lead to an increase in legal security while at the same time increasing tax revenue, as it encourages a transparent declaration of the price to be paid at a later date.
