Medidas cautelares y delito fiscal: ¿Reforma garantista de la LECRIM 2021?
El Ministerio de Justicia ha presentado para su conocimiento público un Anteproyecto de Ley de Enjuiciamiento Criminal que atribuye al Fiscal la dirección de las investigaciones, confiriendo la función de garantía a la autoridad judicial. En materia de delitos fiscales hay una única autoridad investigadora (Fiscalía) que comparte su actuación con la Administración tributaria. El Anteproyecto da un pequeño paso insuficiente para apoderar verdaderamente al Juez de Garantías en el marco de la adopción de medidas cautelares, abandonando la subordinación a proceso administrativo que se mantiene en aras de la rapidez y la inmediata tutela de los intereses de la Hacienda Pública.
The Ministry of Justice has announced a Draft Bill for the Criminal Procedure Law. This Bill makes the Prosecutor responsible for directing investigations, and confers responsibility for procedural safeguards on the judicial authority. There is a single investigating authority for tax crimes (the Office of the Prosecutor), which works with the Tax Administration. The Draft Bill takes a small step which is insufficient to truly empower the judge responsible for procedural safeguards in the adoption of precautionary measures, and relinquishing subordination to an administrative process that is retained for the sake of speed and the immediate protection of the interests of the Tax Authority.
