Fraude… ¿qué fraude?
Cinco años después de que el Tribunal Supremo sentenciara que los pactos sucesorios son, a todos los efectos (también, por tanto, tributarios), mortis causa, el Legislativo -a instancia del Ejecutivo- ha soslayado esa interpretación modificando sustancialmente su régimen fiscal. Un episodio más de serio menoscabo de la seguridad jurídica, además de lo que supone de colonización del Legislativo por el Ejecutivo. Muy preocupante.
Five years after Spain's Supreme Court ruled that inheritance agreements are to all intents and purposes (and therefore also for tax purposes) in contemplation of death, the Legislature - at the request of the Executive - has circumvented this interpretation by substantially modifying its tax regime. This is another example of a serious undermining of legal security, in addition to what a colonisation of the Legislature by the Executive entails. It is highly disturbing.
