¡¡¡¡Liberad al arbitraje testamentario!!!!

Se precisa un reforma del artículo 10 de la Ley de Arbitraje que elimine las injustificadas limitaciones que al arbitraje testamentario impone su redacción actual, suprimiendo toda limitación en cuanto a las materias afectadas por el arbitraje de forma que, liberado de las limitaciones que le impone su actual corsé legislativo, el arbitraje testamentario pueda extenderse a cualquier disputa surgida en relación con la herencia, incluidas las que afecten a las legítimas, lo que sin duda supondría que rápidamente se generalizará su uso, beneficiando tanto a los particulares como a la propia Administración de Justicia.

A reform of article 10 of the Arbitration Law is required to remove the unjustified limitations that its current wording imposes on probate arbitration, eliminating all limitations on the issues affected by the arbitration so that freed from the constraints imposed by its current legislative corset, probate arbitration may be extended to any dispute arising in relation to inheritance, including those that affect forced heirship. This would undoubtedly mean that its use will quickly become widespread, to the benefit of both citizens and the Administration of Justice itself.
