El "Prestige" llega a puerto en Luxemburgo

El pasado 20 de junio de 2022 el Tribunal de Justicia de la Unión Europea dictó su sentencia en el asunto C-700/20, London Steam-Ship Owners' Mutual Insurance Association Limited y Reino de España, más tristemente conocido como el asunto del Prestige. A raíz del naufragio del petrolero Prestige en noviembre de 2002, que provocó una tragedia medioambiental en las costas españolas y francesas, se iniciaron en España acciones penales y civiles contra el capitán y los propietarios del Prestige, así como contra el asegurador London Club. El litigio analizado tiene su origen en la circunstancia de que, habiendo sido considerado civilmente responsable por los tribunales españoles de los daños causados por el naufragio, el London Club se opuso a la ejecución de las resoluciones españolas en el Reino Unido, invocando la sentencia de los tribunales británicos de 2013 dictada en los términos del laudo arbitral favorable.

On 20 June 2022, the Court of Justice of the European Union passed its judgement on case C-700/20, London Steam-Ship Owners' Mutual Insurance Association Limited v Kingdom of Spain, more sadly remembered as the Prestige affair. Following the sinking of the oil tanker Prestige in November 2002, which led to an environmental disaster on the Spanish and French coasts, criminal and civil lawsuits were begun in Spain against the captain and the owners of the Prestige, and against its insurer London Club. The litigation studied originates in the fact that after having been held to have civil liability for the damage caused by the shipwreck by the Spanish courts, London Club opposed the execution of the Spanish rulings in the United Kingdom, invoking the 2013 judgement of the British courts which upheld the arbitration award.
