El derecho a la educación musical es un nuevo concepto de reciente creación histórico-jurídica, que toma su punto de partida en el liberalismo en las artes en la etapa napoleónica, la incorporación del carácter afrancesado en la estructura administrativa y la valoración del gusto por las bellas artes, entre las que se incluye la música. En estas referencias se muestra el incipiente concepto de derecho en términos generalistas y su reflejo educativo en la instrucción propia de la época estudiada, que constituye un punto de inflexión en la historia del derecho a la educación musical. Desde una perspectiva actual, se perciben rasgos de esa etapa francesa en la vida administrativa moderna y en la posterior enseñanza reglada en los conservatorios.
The right to music education is a new and recently conceived historical-legal concept which has its starting point in the liberalism in arts in the Napoleonic period, the implementation of the French perception in the administrative structure and appreciation of fine arts, including music. These references show the incipient concept of law in general terms and its educational reflection in the instruction of the period studied, which constitutes a turning point in the history of the right to music education. From a current perspective, these French traits are perceptible in modern administrative organization and also in the subsequent formal education in conservatories.
