La política criminal y la seguridad ciudadana en Latinoamérica

Proponemos en este trabajo valorar los fundamentos teóricos de la estrecha
interdependencia entre Control Social y Política Criminal. Asumimos que la reacción
ante la criminalidad debe tener connotación socio-estatal, por cuanto este fenómeno
requiere para su enfrentamiento de una acción coordinada entre el Estado y la Sociedad
Civil. Defendemos la concepción de una Política Criminal entendida como estrategia
general de acción que se instituye con el fin de programar el funcionamiento del sistema
de Control Social dirigido a combatir la delincuencia.
Analizamos la controvertida relación entre la seguridad ciudadana y el desarrollo de
Políticas Criminales contingentes, realizando una especial referencia en este sentido al
contexto latinoamericano. Valoramos la realidad latinoamericana a través del
pensamiento de Eugenio Zaffaroni, destacado Jurista de la región, quién con su agudeza
crítica desnuda la realidad de las actuales posiciones en cuanto al Control Social y las
Políticas Criminales en el sub-continente.
En lo que respecta a la experiencia cubana valoramos las actuales condiciones sociopolíticas
y económicas de nuestra sociedad que hacen factible un cambio de Política
Criminal, que como características principales potencie de manera preferente los
mecanismos del Control Social Informal y reduzca consecuentemente el Control Social
Formal y más específicamente el Derecho Penal.

In this article we value the theoretical foundations of the narrow interdependence
between Social Control and Criminal Politics. We assume that the reaction in the face of
the crime rate should have partner-state connotation, since this phenomenon requires for
its confrontation of an action coordinated between the State and the Civil Society. We
defend the conception of a Politics Criminal expert as general strategy of action that is
instituted with the purpose of programming the operation of the system of Social
Control directed to combat the delinquency.
We analyze the controversial relationship between the civic security and the
development of Politicians contingent Criminals, carrying out a special reference in this
sense to the Latin American context. We value the Latin American reality through
Eugenio's thought Zaffaroni, outstanding Jurist of the region, who with their naked
critical sharpness the reality of the current positions as for the Social Control and the
Criminal Politicians in the sub-continent.
In what concerns to the Cuban experience we value the current socio-political and
economic conditions of our society that make feasible Criminal Politics's change that as
characteristic main potencie in a preferable way the mechanisms of the Informal Social
Control and reduce the Formal Social Control consequently and more specifically the
Penal Right.
