Legitimación activa y actiones populares romanae: análisis de los antecedentes romanos de las limitaciones subjetivas a su ejercicio y de los criterios para la elección del actor en caso de concurrencia

Aunque en principio la legitimación activa de las actiones populares estaba abierta a cualquier ciudadano, era necesario que este fuera una persona íntegra y con plena capacidad para postular en juicio, salvo que el asunto fuese de su interés directo. Ello comportó que tuvieran limitaciones o restricciones para interponer su ejercicio los infames, las mujeres, los pupilos, los púberes menores de diecisiete años, los ciegos, los mudos, los sordomudos, los furiosos, los dementes y los pródigos, bien porque no podían postular o bien porque, por las circunstancias propias de su capacidad limitada, la defensa de sus intereses correspondía al tutor o curador al que estaban sometidos. Y si varios ciudadanos querían interponer la misma acción, el magistrado debía escoger al candidato más idóneo, siendo preferible el que tuviera un mayor interés.

Although in principle the active legitimation of the popular actions was open to any citizen, it was necessary that this be a person of integrity and with full capacity to apply in court, unless the matter was of their direct interest. This meant that the infamous, the women, the pupils, the pubescent under seventeen years of age, the blind, the dumb, the deaf-mute, the furious, the insane and the prodigal had limitations or restrictions to file their exercise, either because they could not apply or because, due to the circumstances of their limited capacity, the defense of their interests corresponded to the guardian or curator to whom they were subject. And if several citizens wanted to file the same action, the magistrate had to choose the most suitable candidate, preferring the one with the greatest interest.
