Disfunciones del contrato de trabajo por circunstancias de la producción
Conforme al Diccionario de la lengua española, la disfunción, en su primera acepción, significa desajuste en el funcionamiento o en la función de algo. Así, este estudio parte de la hipótesis de que la redacción dada al contrato de trabajo por circunstancias de la producción en la reforma laboral de 2021 presenta importantes desajustes que condicionan su correcta aplicación. Por ello, en este estudio se plantean tres disfunciones que se consideran claves para la correcta utilización del contrato mencionado, y, a la luz de las mismas, se ofrecen las interpretaciones que se consideran más acertadas.
According to the Dictionary of the Spanish language, dysfunction, in its first meaning, means a mismatch in the operation or function of something. Thus, this study is based on the hypothesis that the wording given to the employment contract due to production circumstances in the 2021 labour reform presents significant imbalances that condition its correct application. For this reason, in this study three dysfunctions are considered that are considered key to the correct use of the aforementioned contract, and, in light of them, the interpretations that are considered most accurate are offered.
