Ganancialidad o privatividad de los derechos de propiedad intelectual e industrial en la sociedad de gananciales

El objeto del presente trabajo es analizar los diferentes medios que, a lo largo de la
historia, ha desarrollado el ordenamiento jurídico español para proteger la propiedad
intelectual e industrial. Con la propiedad industrial se trata de proteger las creaciones del intelecto humano encaminadas a fomentar el progreso técnico, en tanto que la propiedad
intelectual protege la creación de las ideas. La explotación de una obra por los autores
produce beneficios, cuando un autor participa de una sociedad de gananciales se discute
si el producto de ese trabajo le pertenece a él en exclusiva o también a su cónyuge.

The purpose of this paper is to analyze the different means that, throughout history,
the Spanish legal system has developed to protect intellectual and industrial properties.
It is about protecting the creations of the human intellect aimed at promoting technical
progress with industrial property, while intellectual property protects the creation of
ideas. The exploitation of a work by the authors produces benefits, when an author participates
in a matrimonial community of property it is discussed whether the product of
that work belongs to him alone or also to her spouse.
