Valoración penal de las agresiones sexuales en el matrimonio y relaciones afines

La posibilidad de admitir la existencia de una agresión sexual cuando el sujeto activo
y pasivo están casados entre sí no ha sido siempre aceptada de forma unánime. En este
sentido, no ayudaba la antigua rúbrica existente en nuestro Código penal de los delitos
contra la honestidad, pues el yacimiento matrimonial, en ningún caso, podía ser considerado
deshonesto. Este planteamiento no es posible mantenerlo en la actualidad, dado
que el bien jurídico protegido -la libertad sexual- alberga, entre sus manifestaciones, el
derecho de decidir el sí o el no, el cómo, el cuándo, dónde y con quién quiere realizarse
cualquier actividad de aquella naturaleza. De ahí que sea de sumo interés abordar la llamada
circunstancia mixta de parentesco por cuanto que afecta a la medición de la pena; agravando o atenuando la responsabilidad penal, según el caso, a tenor de la relación de
la víctima con su agresor.

help, since the marriage site, in no case, could be considered dishonest. This approach
cannot be maintained at present, given that the protected legal asset -sexual freedomhouses,
among its manifestations, the right to decide yes or no, how, when, where and
with whom you want to carry out any activity of that nature. Hence it is of great interest
to address the so-called mixed kinship circumstance as it affects the measurement of the
penalty; aggravating or attenuating criminal responsibility, depending on the case, based
on the victim’s relationship with her aggressor.
