La respuesta jurídica frente al desafío independentista catalán

El comportamiento del Parlamento y del Gobierno de la Comunidad Autónoma
de Cataluña durante los meses de septiembre y de octubre de 2017 ha
provocado, con toda probabilidad, la crisis más importante de la historia
constitucional de nuestro país desde la aprobación de la Constitución Española
de 1978.
Este trabajo analiza, en primer lugar, las gravísimas infracciones jurídicas
cometidas por las autoridades autonómicas catalanas; repasa, en segundo
lugar, los instrumentos que el Derecho ofrece a los Poderes del Estado para
hacer frente de manera inmediata a la situación de emergencia provocada por
los independentistas catalanes; y ofrece, en tercer lugar, diversas claves para
explicar cómo se puede afrontar el futuro próximo de la ordenación territorial
española y europea.

The behavior of the Parliament and the Government of the Autonomous
Community of Catalonia during the months of September and October of 2017
has provoked, in all probability, the most important crisis in the constitutional
history of our country since the approval of the Spanish Constitution of 1978.
This paper analyzes, in the first place, the very serious legal infractions
committed by the Catalan autonomous authorities; reviews, secondly, the
instruments that the Law offers to the Powers of the State to deal immediately
with the emergency situation caused by the Catalan separatists; and it offers, in
third place, diverse keys to explain how it can face the near future of the
Spanish and European territorial organization.
