El riesgo por lactancia: Delimitación
La sentencia del Tribunal Supremo examinada expone que el riesgo por lactancia debe acreditarse y ser específico. En caso contrario ni se suspende el contrato, ni se devenga el subsidio de Seguridad Social. No basta que una Educadora en Centro de Integración esté expuesta a los riesgos genéricos (agresiones, contagios) del empleo. Su interés lo acredita que cuente con un Voto Particular y que aborde un supuesto relativamente frecuente.
The examined judgment/sentence of the Supreme/High Court states that the risk for breastfeeding must be established and be specific. Otherwise the contract is not suspended and the Social Security subsidy/allowance is not accrued. Not sufficient that an Educator from the Integration Centre is exposed to generic risks (aggression, contagions) of employment. Its interest accredits to have a private vote and to be addressed to a relatively common course.
