El delito de violación

El presente trabajo pretende abrir una línea de investigación para fijar un marco conceptual acerca de la violencia sexual. La pretensión, a lo largo del escrito, es ampliar el análisis desde un punto de vista multidisciplinar, sin perder la referencia del derecho penal sustantivo, donde están tipificadas dichas conductas.
La búsqueda por ese marco teórico jurídico se sustentará bajo el estudio de los tipos penales contra la libertad recogidos en los artículos 178, 179 y 181 de nuestro CP vigente.
A su vez, se irán entrelazando comparativas históricas sobre legislación anterior, así como corrientes filosóficas y doctrinales. Se finalizará con un análisis sobre el derecho penal sustantivo de los ilícitos penales bajo el telón de fondo de la futura firmeza del proyecto de Ley Orgánica de Garantía Integral de Libertad Sexual.

The present work aims to open a line of research to establish a conceptual framework about sexual violence. The intention, throughout the writing, is to expand the analysis from a multidisciplinary point of view, without losing the reference to substantive criminal law, where such behaviors are typified.
The search for this legal theoretical framework will be supported by the study of the types of crimes against freedom included in articles 178, 179 and 181 of our current CP.
At the same time, historical comparisons of previous legislation, as well as philosophical and doctrinal currents, will be intertwined. It will end with an analysis of the substantive criminal law of criminal offenses under the backdrop of the future firmness of the draft Organic Law for the Comprehensive Guarantee of Sexual Freedom.
