El Tribunal Supremo anula el nombramiento de la presidente del Consejo de Estado

La Sala Tercera del Tribunal Supremo en su Sentencia núm. 1611/2023, de 30 de noviembre, en el recurso contencioso-administrativo núm. 918/2022, planteado por la Fundación Hay Derecho contra el Real Decreto 926/2022, de 31 de octubre, por el que se nombra a doña Magdalena Valerio Cordero, Presidenta del Consejo de Estado, estima el recurso al considerar que la entidad recurrente goza de legitimación activa al tener interés legítimo y que la Presidenta del Consejo de Estado sólo cumple uno de los dos requisitos que establece la Ley Orgánica 3/1980, el de experiencia en asuntos de Estado, pero no el de ser jurista de reconocido prestigio, por lo que el mencionado Real Decreto 926/2022, de 31 de octubre, no es ajustado a Derecho, y, por ello, debe ser anulado

In its Ruling No. 1611/2023 of 30 November, the Third Chamber of the Spanish Supreme Court upholds the appeal for judicial review No. 918/2022, filed by the Hay Derecho Foundation against Royal Decree 926/2022 of 31 October, which appointed Ms. Magdalena Valerio Cordero as President of the Council of State. The Ruling considers that the appellant institution has active legal standing to bring the action as it has a legitimate interest, and that the President of the Council of State only meets one of the two requirements set out in Organic Law 3/1980 - having experience in affairs of state - but not the requirement of being a jurist of recognised prestige, and as such the aforementioned Royal Decree 926/2022 of 31 October 2022 is not in accordance with the law, and must therefore be annulled.
