La intervención notarial para lograr la concordancia entre Registro, Catastro y realidad física y jurídica tras la Ley 13/2015, de 24 de junio
Dentro del nuevo sistema de coordinación entre el Catastro, el Registro de la Propiedad y la realidad física y jurídica extrarregistral, el notario interviene en distintos momentos ayudando a identificar los bienes inmuebles objeto del negocio, subsanando las discrepancias en la descripción catastral o en la registral, y remitiendo al Catastro múltiples datos del documento público una vez autorizado. En el texto se analiza esta intervención, con especial atención a los procedimientos de concordancia de los artículos 198 y siguientes de la Ley Hipotecaria y a las recientes resoluciones de la Dirección General de los Registros y del Notariado sobre la materia.
Under the new system of coordination between the Land Registry, the Land Registry and physical and legal reality outside the notary intervenes at different times helping to identify the real estate business object, correcting discrepancies in the Cadastre and returning substantial data in the public deed once authorised. In this text this intervention is discussed with special attention to procedures matching Articles 198 (and the following) of the Mortgage Law and the recent decisions of the General Directorate of Registrars and Notaries on the matter.
