El mecanismo de segunda oportunidad: ¿seguridad jurídica?
El llamado Beneficio de la Exoneración del Pasivo Insatisfecho (acrónimo, “BEPI”), permite a una persona física la posibilidad de encarrilar nuevamente su vida sin tener que arrastrar indefinidamente las deudas anteriores insatisfechas y que actúan como una losa sobre el mismo. Reconociendo la existencia de unos requisitos muy severos para acceder a este beneficio y que el mismo no es un camino de rosas, ni muchísimo menos, se me plantea la duda de que el legislador no ha modificado el artículo 1911 CC y, en consecuencia, el deudor sigue respondiendo de sus deudas con sus bienes presentes y futuros. ¿Se quiebra la seguridad jurídica? ¿Se limita la tutela judicial solo para el deudor? ¿En qué situación queda el acreedor ordinario?
The Benefit of Exemption from Unsatisfied Liabilities (known in Spanish by the acronym "BEPI") gives a natural person the opportunity to get their life back on track, without being dogged indefinitely by previous unpaid debts that are a burden on the Benefit. While acknowledging that the requirements for eligibility to this benefit are very severe, and the fact that it is by no means a bed of roses, the doubt arises as to whether the legislator has not modified Article 1911 of the Civil Code, and debtors consequently continue to answer for their debts with their present and future assets. Is legal security weakened? Is legal protection limited only to the debtor? How is the ordinary creditor affected?
